1. Acknowledgment of Risk
I, the undersigned participant, acknowledge that soccer is a physically demanding sport that carries inherent risks of injury, including but not limited to sprains, fractures, concussions, and, in extreme cases, permanent disability or death. I voluntarily choose to participate in games organized through FutSimple and assume all associated risks.
2. Fitness to Participate
I confirm that I am in good physical condition and have no medical conditions that would prevent me from safely participating in soccer activities. I acknowledge that it is my sole responsibility to consult with a physician before engaging in physical activity if I have any health concerns.
3. Assumption of Risk
I understand and accept that participation in soccer games may result in personal injury, property damage, or other unforeseen consequences. I voluntarily assume full responsibility for any risks, injuries, or damages that may occur as a result of my participation.
4. Release of Liability
I, on behalf of myself, my heirs, and assigns, hereby release and discharge FutSimple, its owners, administrators, organizers, employees, agents, affiliates, sponsors, and any associated facilities from any and all claims, liabilities, demands, actions, or causes of action arising from or related to my participation in FutSimple games, including but not limited to personal injury, property damage, or wrongful death, whether caused by negligence or otherwise.
5. Indemnification
I agree to indemnify and hold harmless FutSimple, its administrators, and all other associated parties from any claims, damages, or expenses, including legal fees, resulting from my actions, negligence, or participation in any FutSimple-organized game.
6. Code of Conduct Compliance
I agree to abide by FutSimple’s rules and regulations, respect other participants and organizers, and conduct myself in a sportsmanlike manner at all times. I acknowledge that FutSimple reserves the right to remove me from games or suspend my participation if I violate these terms.
7. Code of Conduct
I acknowledge that FutSimple welcomes diversity and will not discriminate nor tolerate discrimination against any individual on the basis of race, sex, gender identity, sexual orientation, color, creed, religion, age, national origin, ethnicity, disability, or any other legally prohibited basis. I understand that if I engage in prohibited discrimination or harassment, I will be subject to appropriate discipline by FutSimple, up to and including termination from the game or activity with a lifetime ban.
I also understand that at no time should I lay a hand upon, shove, strike, threaten, or be guilty of physical attack as an aggressor or in retaliation upon any organizer, player, or spectator anywhere in the vicinity of FutSimple games and activities. I agree not to engage in verbally abusive behavior, profanity, bullying, or any conduct that disrupts the game environment. I acknowledge that engaging in such behavior may result in disciplinary action, including warnings, suspension, immediate ejection, or in cases of serious misconduct, a permanent ban from all future FutSimple games and activities.
8. Emergency Medical Treatment Authorization
In the event of a medical emergency, I authorize FutSimple and its representatives to obtain medical treatment on my behalf if deemed necessary. I understand that I am responsible for all costs associated with any medical care or emergency services received.
9. Photo and Video Release
I grant FutSimple the right to capture and use photos and videos taken during games for promotional, marketing, and social media purposes without compensation.
10. Electronic Signature Consent
By selecting the “Attend” button on any FutSimple game or activity hosted on the Meetup.com or Futsimple.com, responding to a game invitation via WhatsApp, Instagram, or any other online platform used by FutSimple, I affirm that I have read and understood all of the terms and conditions contained in this waiver and release of liability. I agree to all terms outlined herein and consider this action my electronic signature. I consent to the use of my electronic signature in lieu of an original signature on paper. By selecting “I agree” or confirming my participation in any manner, I waive the right to sign a paper copy of this waiver but understand that I may request a paper copy if needed.
11. Agreement to Terms
I HAVE READ THE ABOVE WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO THEM, AND AGREE TO THEM VOLUNTARILY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE. I INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
1. Reconocimiento de Riesgo
Yo, el abajo firmante participante, reconozco que el fútbol es un deporte físicamente exigente que conlleva riesgos inherentes de lesiones, que incluyen, pero no se limitan a, esguinces, fracturas, conmociones cerebrales y, en casos extremos, discapacidad permanente o muerte. Elijo voluntariamente participar en los juegos organizados a través de FutSimple y asumo todos los riesgos asociados.
2. Aptitud para Participar
Confirmo que me encuentro en buen estado físico y no tengo condiciones médicas que me impidan participar de manera segura en actividades de fútbol. Reconozco que es mi responsabilidad consultar a un médico antes de participar en actividad física si tengo alguna preocupación de salud.
3. Asunción de Riesgo
Entiendo y acepto que la participación en los juegos de fútbol puede resultar en lesiones personales, daños a la propiedad u otras consecuencias imprevistas. Asumo voluntariamente toda la responsabilidad por los riesgos, lesiones o daños que puedan ocurrir como resultado de mi participación.
4. Exoneración de Responsabilidad
Yo, en nombre de mí mismo, mis herederos y cesionarios, por la presente libero y eximo de responsabilidad a FutSimple, sus propietarios, administradores, organizadores, empleados, agentes, afiliados, patrocinadores y cualquier instalación asociada de todas las reclamaciones, responsabilidades, demandas, acciones o causas de acción que surjan de o estén relacionadas con mi participación en los juegos de FutSimple, incluyendo, pero no limitado a, lesiones personales, daños a la propiedad o muerte injusta, ya sea causada por negligencia o de otro modo.
5. Indemnización
Acepto indemnizar y eximir de responsabilidad a FutSimple, sus administradores y todas las demás partes asociadas de cualquier reclamación, daño o gasto, incluyendo honorarios legales, que resulten de mis acciones, negligencia o participación en cualquier juego organizado por FutSimple.
6. Cumplimiento del Código de Conducta
Acepto cumplir con las reglas y regulaciones de FutSimple, respetar a otros participantes y organizadores, y conducirme de manera deportiva en todo momento. Reconozco que FutSimple se reserva el derecho de excluirme de los juegos o suspender mi participación si violase estos términos.
7. Código de Conducta
Reconozco que FutSimple da la bienvenida a la diversidad y no discriminará ni tolerará discriminación contra ninguna persona por motivos de raza, sexo, identidad de género, orientación sexual, color, credo, religión, edad, origen nacional, etnia, discapacidad o cualquier otro motivo prohibido por la ley. Entiendo que si participo en discriminación o acoso prohibido, estaré sujeto a una disciplina apropiada por parte de FutSimple, que podrá incluir la terminación de mi participación en el juego o actividad con una prohibición de por vida.
También entiendo que en ningún momento debo poner las manos sobre, empujar, golpear, amenazar ni ser culpable de un ataque físico como agresor o en represalia contra cualquier organizador, jugador o espectador en cualquier lugar cercano a los juegos y actividades de FutSimple. Acepto no participar en comportamientos verbalmente abusivos, usar palabrotas, acosar o cualquier conducta que interrumpa el ambiente del juego. Reconozco que participar en dicho comportamiento puede resultar en medidas disciplinarias, que incluyen advertencias, suspensión, expulsión inmediata o, en casos de mala conducta grave, una prohibición permanente de todos los futuros juegos y actividades de FutSimple.
8. Autorización para Tratamiento Médico de Emergencia
En caso de una emergencia médica, autorizo a FutSimple y sus representantes a obtener tratamiento médico en mi nombre si se considera necesario. Entiendo que soy responsable de todos los costos asociados con la atención médica o los servicios de emergencia recibidos.
9. Autorización para Uso de Fotos y Videos
Otorgo a FutSimple el derecho de capturar y utilizar fotos y videos tomados durante los juegos con fines promocionales, de marketing y en redes sociales sin compensación.
10. Consentimiento de Firma Electrónica
Al seleccionar el botón “Yo acepto” en cualquier juego o actividad de FutSimple alojado en Meetup.com o Futsimple.com, responder a una invitación para un juego a través de WhatsApp, Instagram o cualquier otra plataforma en línea utilizada por FutSimple, afirmo que he leído y entendido todos los términos y condiciones contenidos en esta exoneración de responsabilidad. Acepto todos los términos expuestos en este documento y considero esta acción como mi firma electrónica. Consiento el uso de mi firma electrónica en lugar de una firma original en papel. Al seleccionar “Asistir” o confirmar mi participación de cualquier manera, renuncio al derecho de firmar una copia en papel de esta exoneración, pero entiendo que puedo solicitar una copia en papel si es necesario.
11. Acuerdo con los Términos
HE LEÍDO LA EXONERACIÓN DE RESPONSABILIDAD ANTERIOR, ENTIENDO COMPLETAMENTE SUS TÉRMINOS, ENTIENDO QUE HE RENUNCIADO A DERECHOS IMPORTANTES AL ACEPTARLOS Y LOS ACEPTO VOLUNTARIAMENTE Y SIN INDUCIMIENTO O GARANTÍA DE NINGÚN TIPO. TENGO LA INTENCIÓN DE QUE SEA UNA EXONERACIÓN COMPLETA E INCONDICIONAL DE TODA RESPONSABILIDAD EN LA MEDIDA EN QUE LO PERMITA LA LEY Y ACEPTO QUE, SI ALGUNA PARTE DE ESTE ACUERDO SE DECLARA INVÁLIDA, EL RESTO DE LA EXONERACIÓN SE MANTENDRÁ EN VIGOR Y EFECTO.
